It’s Up to Chief Justice Roberts to Protect the Court

CLAY: We were talking, obviously, about the attempted assassination of Brett Kavanaugh, attempted murder, however you want to classify it. A man was arrested at 1:45 a.m. outside of Brett Kavanaugh’s home in Maryland. And evidently told authorities that he was there because he supported Roe v. Wade being law. And unfortunately, his thought process is, “If I kill Brett Kavanaugh before this opinion becomes law, then there wouldn’t be five votes,” at least based on the leaked Supreme Court data, which is why we have said so much danger was put in place by that leak, that whoever leaked that nearly had Supreme Court justice blood on their hands.

Thank God there was security there. There were armed security guards who were able to take care of this armed, would-be assassin. And I don’t know if anybody inside of the Supreme Court listens to our show or ever pays attention to it. But as a lawyer, I know that Chief Justice Roberts cares desperately about the legitimacy of the court, and if he truly cares about the legitimacy of the court and the sanctity of the court he needs to join the majority opinion here and make it 6-3, because the incentive structure…

I hate to even have to talk about this, but if it’s a 5-4 decision until it comes out all these Supreme Court justices in the majority are in grave danger. And also once it comes out, if it comes out as a 5-4 decision, someone in their twisted mind could make the decision, “I want to kill one of these justices in the majority.” Biden would appoint a new one and it would flip back the other direction. It needs to be a 6-3 decision.

BUCK: The threat is only to the conservative constitutionalist justices, as we all know.

CLAY: That’s right. That’s who the threat is to.

BUCK: The threat is only coming from Biden-voting, zealot, lunatic pro-abortion individuals. That’s actually where the threat is coming from. That is the reality of this political moment. And we all know it, but you’ll see a lot of CNN and MSNBC, “Oh, the general political temperature has really gone up recently.” No, no. You have one side that’s saying, “Let’s protect babies and actually adhere to the Constitution,” and the other side, “You better keep our crazy constitutional right of abortion or else!” That’s what’s going on.

CLAY: It’s scary, and this is why I was so angry and still am so furious about whoever leaked this draft opinion and got it out into the public because it put a direct target — that this guy tried to act on — on Brett Kavanaugh, and then the continuation of publishing their addresses and everything else and the protest has continued that threat.
